terms & conditions

effective 1 september 2026 · content hub, security and merchant sections added 13 october 2026

1. who we are

nima is an influencer collaboration platform that connects content creators with brand campaigns. nima operates independently of magos media, from the same registered offices in johannesburg, south africa. references to "we", "us" and "our" in these terms mean nima; "you" means the creator or visitor using the platform.

2. the platform

nima lets creators apply to join our network, maintain a profile of their audience statistics and rates, receive campaign briefs, and report campaign performance. applying to join, or being listed in the network, does not guarantee campaign work, income, or any ongoing relationship. each actual collaboration is agreed separately per campaign.

3. eligibility & your profile

you must be at least 18 years old to join in your own capacity. creators aged 13–17 may only be registered with the involvement and consent of a parent or legal guardian, who accepts these terms on their behalf.

you undertake that everything in your profile (follower counts, audience demographics, engagement rates, rates and contact details) is accurate and kept up to date, and that the social accounts you list are genuinely yours (or ones you are authorised to represent). we may suspend or remove profiles containing false or misleading information.

4. campaigns, briefs & reporting

when you are matched to a campaign, the brief on your profile page sets out the deliverables, timelines and requirements. by accepting a campaign you agree to deliver as briefed, to comply with applicable advertising rules (including the ARB code and platform disclosure rules for sponsored content), and to submit truthful performance statistics with genuine, unedited screenshot proof. fabricated statistics are grounds for immediate removal from the network.

5. rates, payment & exclusivity

rates in your profile are indicative. fees, payment terms and any usage or reshare licences for a specific campaign are agreed in writing (which may be by email or contract) before that campaign begins, and that agreement governs payment, not these terms.

if you declare exclusivity obligations in your profile, you are responsible for their accuracy. you must not accept a campaign that would breach an exclusivity agreement you hold with any brand.

6. content & intellectual property

you keep ownership of the content you create. by submitting material to nima (profile photos, media kits, campaign statistics and screenshots), you grant us a non-exclusive licence to use it for operating the platform: evaluating your profile, presenting you to prospective brand clients, and reporting campaign performance to the relevant brand. usage rights for campaign content itself (e.g. a brand resharing your post) are agreed per campaign as described in section 5.

the nima name, logo and platform are our property; nothing in these terms grants you rights to them.

7. acceptable use

you may not misuse the platform, including attempting to access other people's data, submitting malicious files, scraping the platform, misrepresenting your identity, or using the platform for anything unlawful. we may suspend access to protect the platform and its users.

8. leaving the network

you may leave at any time by emailing info@magosmedia.co.za, and we will remove your profile (subject to completing any campaign already in progress and to records we must keep by law). we may remove profiles that breach these terms or that have been inactive for an extended period.

9. liability

the platform is provided "as is". to the maximum extent permitted by south african law, we are not liable for indirect or consequential loss, loss of profits, or loss of opportunity arising from use of the platform, and our total liability for any claim is limited to the fees actually paid to you or by you (as applicable) for the campaign giving rise to the claim. nothing in these terms limits liability that cannot lawfully be limited, or your rights under the consumer protection act where it applies.

10. content hub purchases

what you buy. a content hub purchase is a non-exclusive licence to use one specific video (the "content") in your own marketing channels, delivered as a digital file download the moment payment is confirmed. you preview the watermarked version first; the title, description, duration, resolution, dimensions and file size are shown on each video's page. no physical goods are shipped.

pricing. all prices are quoted and charged in south african rand (ZAR). the price shown on the video is the full amount payable; there are no delivery charges. magos media (pty) ltd is VAT registered and all displayed prices are inclusive of VAT at the prevailing rate; a VAT invoice is available on request.

payment methods. payments are processed by payfast (payfast (pty) ltd), a PCI DSS level 1 service provider, and accepted by credit and debit card (visa, mastercard), instant EFT, and the other methods payfast offers at checkout. your card details are entered on payfast's secure pages and are never seen or stored by nima.

delivery. your download link appears on the confirmation page and is emailed to you the moment payfast confirms payment; it stays valid for as long as the licence is in force. the clean (unwatermarked) file is delivered only after payment.

licence. you may publish, edit and adapt the content in your own channels and paid media worldwide. you may not resell, sublicense or redistribute the file itself, or claim authorship. the creator keeps copyright and moral rights. the licence is withdrawn if a purchase is refunded.

returns and refunds. digital content cannot be returned once downloaded. refunds are available within 7 days for a defective, misdescribed or unlicensable file, under our refund policy, which forms part of these terms.

export restrictions. none. the content is delivered digitally and may be used worldwide, subject to the laws of the country in which you use it.

11. security

all traffic to nima is encrypted in transit (HTTPS/TLS). passwords are stored only as salted one-way hashes. uploaded files and media are held on access-controlled infrastructure (amazon web services, af-south-1 region) and served through time-limited links. we never handle or store card numbers: payment pages are hosted by payfast. forms are protected against automated abuse (cloudflare turnstile and rate limiting), administrative access is limited to the nima team behind individual logins, and database backups are taken daily. report a security concern to info@magosmedia.co.za.

12. merchant details and customer service

nima is a trading name of magos media (pty) ltd, a company registered and domiciled in the republic of south africa, with its registered office at 5 fricker road, illovo, johannesburg, 2196. customer service: info@magosmedia.co.za or +27 11 268 6172, monday to friday 08:30 to 17:00 (SAST). we aim to answer within 2 business days.

13. general

these terms are governed by the laws of the republic of south africa, including the consumer protection act and the electronic communications and transactions act. we may update these terms from time to time; the current version is always at this page, and material changes will be flagged to active network members. if any provision is unenforceable, the rest remain in force. your personal information is handled as described in our privacy policy.
